# Lumaft End User License Agreement (EULA)

## 1. Acceptance and Scope

This Lumaft End User License Agreement ("License") is a legal agreement between you (either an individual or a legal entity) and Dekglas LLC ("Dekglas"). By downloading, pulling, installing, or using the Lumaft container image ("Software"), you agree to be bound by the terms of this License. The Software is offered in multiple editions, including a free "Community Edition" and multiple tiers of commercial "Licensed Editions."

## 2. License Grant

Subject to your compliance with this License, Dekglas grants you a limited, non-exclusive, non-transferable, and non-sublicensable right to install and execute the object code of the Software for your internal business or personal purposes, including connecting the Software to production infrastructure.

**Community Edition:** You may use the Community Edition free of charge.

**Licensed Editions (All Tiers):** Access to the features of any Licensed Edition requires a valid, active license key purchased from Dekglas. The Software is offered in multiple licensed tiers, each unlocking specific features, capacities, or usage limits. You may only use the features and capacity corresponding to the specific Licensed Edition tier you have purchased, for the duration specified in your purchase order.

**Enterprise Advanced Security:** Enterprise Advanced Security is a Licensed Edition intended for offline, air-gapped, and restricted environments. It is activated by a signed license document issued by Dekglas and installed alongside the Software, rather than by a license key validated against Dekglas license servers, and the Software makes no outbound connection to Dekglas when operating under an Enterprise Advanced Security license. References in this License to a "license key" include such signed license documents.

**No Source Code:** This License does not grant any rights to the source code of the Software.

## 3. Restrictions

You may not, and may not permit any third party to:

- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Software.
- Redistribute, mirror, rehost, resell, lease, or commercially bundle the Software or the container image.
- Provide the Software as a commercial service, SaaS, or service bureau to third parties.
- Bypass, disable, block, or circumvent any technical limitations, license-key mechanisms, or license-server validation within the Software in order to access tiers or features you have not purchased.

## 4. Data Custody and Ownership

**Your Data:** You retain full and exclusive ownership of all data, metrics, and records generated, ingested, or stored by your use of the Software (including the local SQLite database). Dekglas has no access to, and claims no ownership over, your infrastructure data. Termination or downgrade of this License never entitles Dekglas to destroy, withhold, or demand the deletion of your data.

**Dekglas IP:** Dekglas retains all right, title, and interest, including all intellectual property rights, in and to the Software, its documentation, and any updates.

## 5. Support, SLAs, and Security Updates

Unless governed by a separate, signed enterprise agreement corresponding to your specific Licensed Edition tier, the Software is provided without any guaranteed response times, Service Level Agreements (SLAs), or formal support obligations. Dekglas may provide updates, patches, and security fixes at its sole discretion. Any security fixes released for the Software will be made available to the Community Edition and will never be paywalled.

## 6. Feedback

If you provide Dekglas with any suggestions, bug reports, feature requests, or other feedback regarding the Software ("Feedback"), you grant Dekglas a perpetual, irrevocable, royalty-free, and worldwide license to use, modify, and incorporate such Feedback into the Software or other products without obligation or compensation to you.

## 7. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. YOUR USE OF THE SOFTWARE IN ANY ENVIRONMENT, INCLUDING PRODUCTION ENVIRONMENTS, IS STRICTLY AT YOUR OWN RISK.

## 8. Limitation of Liability

IN NO EVENT SHALL DEKGLAS LLC BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF, OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE. THIS INCLUDES, WITHOUT LIMITATION, LIABILITY FOR INFRASTRUCTURE DOWNTIME, DATA LOSS, SYSTEM FAILURE, OR LOST PROFITS. IN NO EVENT SHALL DEKGLAS LLC'S TOTAL CUMULATIVE LIABILITY EXCEED THE AMOUNT PAID BY YOU FOR THE SOFTWARE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY US DOLLARS ($50.00) IF NO AMOUNTS WERE PAID.

## 9. Term and Termination

This License is effective until terminated. You may terminate it at any time by deleting the Software and all copies. Dekglas may terminate this License immediately upon notice if you breach any term or fail to pay applicable fees for your respective Licensed Edition tier. Upon termination, you must cease all use of the Software. Sections 3, 4, 6, 7, 8, and 10 shall survive termination.

## 10. General Provisions

**Export Compliance:** You agree to comply with all applicable US export control laws and regulations regarding the use and distribution of the Software.

**Governing Law:** This License shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.
